HOA ELECTIONS

HOA Elections of California Rules: As of July 1, 2006, all Associations must have adopted election rules. (Civ Code §5105(a)). If rules are not adopted there are several costly legal challenges that may void the previous election results. Pertaining to Director Elections there were significant changes made January 1, 2020 within the Davis-Stirling Act. Election Rules were required to be amended within California and should include the following: - Nomination Procedures - Director Candidate Qualifications. - Inspector of Election Services (Third Party Independent Review). - Rules for access to Association Media during Campaigns. - Rules for Access to Common Area Meeting Space during Campaigns. - Secret Ballot Procedures. - Procedures for Uncontested Elections. - Recall Election Procedures. - Documentation of all Election Materials. Potential Elections that occur within an Association include but are not limited to: - Election of Directors. - Removal of Directors. - Special Assessments. - Amendments to the CC&Rs and Bylaws. - Grants of Exclusive Use Common Areas.

Process of Amending Election Rules. Rule Amendments are required per the Davis- Stirling Act, wherein election rules cannot be amended less than 90 days prior to an election. (Civ. Code §5105(h)). Additionally, there needs to be a 28 day notice period for membership review of proposed change of rules. (Civ. Code §4360(a)) furthermore, the waiting period for updating election rules is extended to 118 days (4 months) since the change cannot be approved by the board until the end of the 28 days.

Voter List and Candidate Registration. 6.) Ballot and Election Rule Mailing Date / Finalize Voter List. 7.) Voting Deadline and Ballot Counting Meeting.
